The mission of the Idaho Department of Correction is to protect the public, our staff, and those within our custody and supervision through safety, accountability, partnerships and providing opportunities for offender change.

Please note changes have been made to this exam to include the standards required for the Department’s compliance with the Prison Rape Elimination Act (PREA) of 2003. You must complete both exams attached to this announcement to be considered for this position.

The Idaho Department of Correction (IDOC) has a vacancy for a Legal Assistant for the South Boise Correctional Complex to include South Boise Women’s Correctional Center (SBWCC), Idaho Maximum Security Institution (IMSI), Idaho State Correctional Institution (ISCI), South Idaho Correctional Institution (SICI) and Idaho State Correctional Center (ISCC).

Legal Assistants perform paralegal activities which include exhaustive and in-depth research, drafting of summaries and briefs, investigative interviewing, composing interrogatories, and assisting in discovery and trial preparation. These activities relieve attorneys of substantive legal functions in areas that do not require law degrees when done under the supervision of an attorney. Issues requiring legal interpretation or opinion are referred to an attorney. Employees in these positions must have a thorough understanding of legal ethics and the need for confidentiality.

RESPONSIBILITIES:

  • Provide and explain authorized legal resources to offenders
  • Research case law, federal and state laws and rules, legal periodicals, and administrative rules and policies
  • Maintain computerized data base system to track case documentation and data entry
  • Research and respond to inquiries from interested parties, attorneys, judicial and department staff regarding legal processes and clarification of policies
  • Provide notary services upon request

MINIMUM QUALIFICATIONS:

  • Good knowledge of legal research methods
  • Good knowledge of the court system and procedures
  • Good knowledge of legal ethics
  • Experience interpreting and analyzing judicial decisions and statutes
  • Experience identifying and preparing appropriate legal documents
  • Experience applying facts to case law in analysis and briefs
  • Experience drafting legal documents and related correspondence
  • Experience using a tickler system and tracking documents on a computerized database

SPECIALITY REQUIREMENT:

  • Must be willing to work in an Adult Correctional Facility

HIRING INFORMATION:

To be hired, candidates will have a history and background supportive of department mission goals and will be subject to:

  • Completing a Background Investigation Questionnaire and pre-employment drug testing
  • Having a federal and state criminal background check to include fingerprints
  • Having a history of law-abiding behavior
  • Felonies, misdemeanors, illegal drug usage, DUI's, adverse driving convictions and employment history may make you ineligible for employment

Non-hiring restrictions are in place for candidates who:

  • Have been convicted of Domestic Violence or similar types of violent behaviors
  • Have a dishonorable discharge from military service
  • Currently are using, dealing or are associated with illegal drugs
  • Have close friends or relatives under IDOC care & custody where the vacancy exists
  • Are currently under IDOC supervision or probation (must be released from IDOC supervision or probation for at least one year)

EXAMINATION:

  1. Prison Rape Elimination Act (PREA) - In compliance with the Prison Rape Elimination Act (PREA) of 2003, we are required to obtain certain information in the exam/interview process and consider specific information when making hiring and selection decisions for positions that have contact with inmates "in a prison, jail, lockup, community confinement facility, juvenile facility, or other institution..." The PREA Standards do not require we obtain this information for positions not within a correctional facility such as Probation & Parole and Central Office positions. Again, these changes are being implemented in order for the department to the meet the requirement of PREA standards.   2. Minimum Qualifications Exam - You will receive a score based on your education and experience in the answers to the exam. A minimum score of 83 is required to pass.
