I don’t agree with a determination. How do I appeal?
You have the right to appeal a determination made by the Idaho Department of Labor. To be valid, your appeal must:
- Be in writing.
- Be signed by you or your representative.
- Ask for an appeal hearing.
- State the determination being appealed.
- Be filed within 14 days from the mailing date of the determination.
Who can appeal?
Any interested party can appeal a determination. The term “interested party” includes:
- Claimants.
- Employers, when applicable.
- A representative of the above.
- An authorized representative of the department.
How do I file my appeal?
An appeal may be filed by:- Sending an email to appealsmail@labor.idaho.gov.
- Faxing the appeal to the Appeals Bureau at (208) 334-6440.
- Handing in the appeal to the Appeals Bureau at 317 W. Main St., Boise, Idaho 83735.
- Mailing the appeal to the address above.

Must an appeal be filed by a certain time?
Yes. You must file an appeal within 14 days of the mailing date on your determination. The mailing date is the day the document was sent, not the day you got it.
- If you hand-in your appeal in person, it will be stamped and filed that day.
- If you mail your appeal, it will be filed as of the postmark date.
- If you fax or email your appeal, it will be filed on the day received.
Note: An email or fax received after 12:00 a.m. Mountain Time will be deemed received by the Appeals Bureau on the next business day.
What if I file my appeal after the 14-day deadline?
If you don’t file your appeal by the end of the 14-day period, the determination will be final. It cannot be changed except in a hearing.
If you file an appeal after the deadline, the Appeals Bureau will schedule a hearing. This hearing will decide whether the appeal has been timely filed given your situation.
