  1. Information CollectedThe Department collects personally identifiable information directly from individuals who volunteer to use some of our services. Collection of this information is required to deliver the specific services, but use of these services is purely voluntary.

    If you do nothing during your visit to the Department's web site, but browse or download information, we automatically collect and store the following information about your visit:

    1. The Internet Protocol Address and domain name used, but not the e-mail address. The Internet Protocol Address is a numerical identifier assigned either to your Internet service provider or directly to your computer. We use the Internet Protocol Address to direct Internet traffic to you and generate statistics used in the management of this site.
    2. The type of browser and operating system you used.
    3. The date and time you visited this web site.
    4. The web pages or services you accessed at this web site.

    The information we automatically collect or store is used to improve the content of our web services and to help us understand how persons are using the services provided. Additional Terms and Conditions Specific to Labor Exchange SystemThe Department administers the labor exchange system within the state of Idaho by bringing together individuals who are seeking employment and employers who are seeking workers. IdahoWorks is the program that lists job orders and provides job seeker information to registered employers on the Department's web site. The following are additional terms and conditions specific to the labor exchange system. The Department encourages both employers and job seekers to read all of the provisions of this paragraph (10) to understand the additional terms and conditions that apply to the labor exchange system.

    1. Employer Job EntryEmployer Job Entry (EJOE) is an Internet program, external to IdahoWorks, that allows employers to directly enter and manage their own job listings anytime day or night. Use of the service is purely voluntary.

    2. Voluntary Employer RegistrationYou must register to use the system and the registration information must be validated by Department staff before a customer profile or job referral information is made available to you. By registering for EJOE services, a unique e-mail address and password will be assigned by you. The e-mail address and password are required for all future access to the system. You are responsible for protecting the confidentiality of your own unique e-mail address and password.

    3. Job Listing and ReferralsYou may manage your own job listings and referrals, or Department staff may assist you with these processes. Upon registration and validation, you may review the profiles and searchable resumes of applicants referred to your job listing. All new job listings and your employer records, and any updates, will first go to a queue and must be reviewed by Department staff before being forwarded to IdahoWorks.

    4. No Referral in Case of Labor DisputeThe Department shall make no job referral on job orders which will aid directly or indirectly in the filling of a job opening which is vacant because the former occupant is on strike, or is being locked out in the course of a labor dispute, or the filling of which is otherwise an issue in a labor dispute involving a work stoppage.

    5. Monetary InvestmentsNeither the employer nor employer's agents may require a significant monetary investment by a job seeker in order to obtain employment. Usual and customary licensing fees or certifications are acceptable. Purchasing kits or work-from-home plans are not acceptable.

    6. Employer-Employee RelationshipJob listings entered into the IdahoWorks system must be for direct employer-employee relationships. For an employer-employee relationship to exist, the employing organization must be responsible for the hiring, firing, and supervising of, and the paying of wages to, the employee.

    7. Employment-Related LawsEmployers agree that they will comply with all applicable federal, state and local-employment related laws and regulations, including health and safety laws and the Idaho Contractor Registration Act.

    8. Unemployment TaxesEmployers agree that they will comply with all provisions of Idaho Employment Security law and Federal Unemployment Tax Act and their regulations for each job listing they enter.

    9. Workers CompensationEmployers agree that each job listing will be covered by the employer's Workers Compensation Policy.

    10. RemovalThe Department reserves the right to remove any job posting that contains inaccurate or inappropriate information.

    11. Discontinuation of Employer ServicesThe Department may discontinue services to employers under the following circumstances: An employer submits and refuses to alter or withdraw job orders containing specifications which are contrary to employment-related laws; an employer submits job orders and refuses to provide assurances appropriate for agricultural clearance orders that the jobs are compliant with employment related laws, or refuses to withdraw such job order; an employer is found through field checks or otherwise, to have misrepresented the terms or conditions of employment; when a job service related complaint is filed against an employer and the appropriate enforcement agency has found by a final determination that the employer has violated employment related laws; an employer has violated a job service regulation; an employer refuses to accept qualified workers referred through the clearance system; an employer refuses to cooperate in the conduct of field checks at agricultural work sites to which referrals have been made through the intrastate or interstate clearance system; or an employer repeatedly causes the initiation of procedures for discontinuation of services. The Department will send written notification to the employer that it intends to discontinue services and cite the basis for the determination. The employer will be given an opportunity to respond and request a hearing before services are discontinued.

    12. AccessEmployers control how job seekers contact them from the job posting. No employer information will be sold for any purpose.

    13. FeesNeither you nor your agents may charge a fee to provide a job seeker with access to a job referral or as a condition of accepting a job.

    14. Customer Profile UseNeither you nor your agents may use customer profiles or referral information for any purpose other than to fill an immediate job opening. You may not resell or repost customer profile or referral information, whether in whole or in part.

    15. Jobs PostedJobs posted on the website must be for an immediate opening. Business opportunities are not considered immediate openings. All jobs must adhere to state and federal minimum wage laws. The current state and federal minimum wage is $7.25 per hour. State minimum wage information is available at the Guide to Idaho Labor Laws and federal minimum wage information at US Department of Labor Compliance Assistance: Fair Labor Standards Act (FLSA).

    16. Employment DiscriminationNeither you nor your agents may use customer profile or job referral information to directly or indirectly discriminate against job applicants on the basis of race, color, religion, gender, age, national origin or disability.

    17. Services Offered to Job SeekersIdahoWorks is the program which sets out employment services offered to job seekers on the Department's Job Search web site. The Job Search web site is a resource that you can use to assist you in your job search and career. You may visit this web site and conduct job searches, access on-line job search guide, review career information or visit third party web sites without having to register. The Department also offers employment services that require you to register on-line. These services include accessing job referral information for a particular job listing and the Department's on-line resume services. Registration on-line is on a purely voluntary basis.

    18. Voluntary Registration for Job Referral and On-Line Resume ServicesIn order to access job referral information for a particular job, or the Department's on-line resume services, you will need to register in Idaho Works and to create an account for yourself. You will enter a unique user identification number to create a registration file. You shall be responsible for protecting the confidentiality of your user identification number. The user identification number will allow you to interact with certain on-line services. You may store employment related documents on your registration file.

    19. On-Line Resume ServicesThe Department offers two types of resume services.

      1. The first service allows you to store up to 1.5 megabits of information to your Registration file. This service allows you to download employment related documents about yourself, such as a cover letter, resume, employment history and list of references. You can add, edit, delete and save files to your Registration file. Your saved file can be kept for the life of your Registration file. Saved files may be attached to the searchable resume allowing an employer to access these designated files.
      2. The second resume service is the "searchable profile". This service permits you to enter employment related information by use of a wizard format with predefined fields and dropdowns. You can direct which fields can be viewed by potential employers by selecting privacy setting options. All contents of the searchable profile can be updated by you. You can also attach saved files to your searchable profile and allow employers to access these designated files.

      All users of the searchable profiles will be required to have either an e-mail address or text message telephone number.

    20. Discontinuation of Services to Job SeekersThe Department may discontinue services to job seekers under the following circumstances: Any activity or behavior that disrupts the Department's web site, or disrupts an employer's place of business when referred for a job interview; threatening or intimidating behavior; use of offensive or abusive language; misuse and tampering with Department's resources; or engaging in criminal activity. The Department will send written notification to the job seeker that it intends to discontinue services and cite the basis for the determination. The job seeker will be given an opportunity to respond and request a hearing before services are discontinued.

    21. Accuracy or Truthfulness of InformationThe Department shall not be a guarantor of the accuracy or truthfulness of information obtained from employers or job seekers in the process of operating a labor exchange activity. The Department assumes no duty to monitor the activities of this web site.

    22. The Department is not an Employer or Party to the Employment ContractThe Department's acceptance of a job listing from a potential employer, or the Department's recruitment of a worker for a specific job listing does not constitute a contractual job offer to which the Department is a party.

    23. Veterans Preferences.The Department is required by law to provide maximum employment and training opportunities to eligible veterans and eligible persons, with priority given to disabled veterans and veterans of the Vietnam-era, by giving them preference over non-veterans in the provision of employment and training services.
